November 18, 2021 – Council Minutes

The mayor called the meeting to order at 7:00 pm Thursday, November 18, 2021.   The pledge of allegiance was given by D Burke and the prayer given R Burke.     

The Mayor asked the clerk to call the roll:

Amend Agenda:

Councilman Datwyler moved to amend the agenda to allow for the 2nd reading of Ordinance #2021-624.  Motion seconded by Councilwoman King. 

The mayor called for a voice poll:  all in favor none opposed.

Public Hearing:

Stones Express Lube:

Ione Hansen, Planning/zoning administrator, presented the purpose of the applicate.  There are presently two buildings on the lot.  One of the buildings has been sold and needs a legal address and legal boundary.  The proposed lot split will provide adequate parking for both buildings and no change in zoning. 

Public Comment:  None

Councilwoman King moved to approve the lot split seconded by Councilman D Burke.

Idaho Sunfresh/Burbank Properties:   

Kendall Rolfe, representing the applicant has purchased additional land east of the present potato warehouse in which to expand their current operation.  The newly acquired land is zoned commercial and to be compliant with the city zoning needs to be zoned industrial, the same as the existing warehouse.  Public works director Mitch Bradley stated the addition will not connect to the city’s sewer system and will need water only, which the city can supply. 

Public Comment:  None

Councilwoman Harrison moved to allow the re-zoning of the property from commercial to industrial seconded by Councilwoman King.

Annexation – Henry/ Briggs Property:

John Henry representing the property owners came forward and expressed interest in annexing 77 acres south of the Burgess Canal along 3900 East along with three existing homes.  The planning/zoning commission has recommended the request for annexation be approved.  The property with have an R-1 zone – single family consisting of 1/3 to 1/4 acre lots.  The Burgess Canal has given their concurrence on the proposed development as has Rocky Mountain Power and Intermountain Gas.  The existing water rights will be transferred to the city.  The development will be done in phases with the area adjacent to the canal and west being developed first. 

Public Comment:  None

Council expressed their thanks to the Henry’s for requesting to be annexed and with the development being for single family homes. 

Councilman Datwyler moved to accept the annexation with an R-1 zone seconded by Councilwoman King.

2nd Reading of Ordinance #2021-624 – Annexation of The Grove Development:

The mayor indicated this would be the second reading for the ordinance.  Councilwoman moved the ordinance be read in title and summary only seconded by Councilman Datwyler. 

The mayor called for a voice poll:  all in favor none opposed. 

The mayor reads the title and summary of the ordinance.

He stated the council could waive the 3rd reading and move to pass.  Hearing none he moved to the next item on the agenda.

Certification of November 2, 2021 election results:

The clerk presented the council with the official tabulation of the November 2, 2021 elections that he had received from Jefferson County.  Copy of the summary of Jefferson County’s Board of Canvassers attached.

Councilwoman King moved the council having reviewed the tabulation accept and approve the election seconded by Councilwoman Harrison.

RFQ Engineering Services:

Mitch Bradley, Public Works Director, came forward and stated he felt it was perhaps time for the city to expand the number of engineers that were qualified to submit proposals on city public works projects.  Currently on one or two of the classifications the city only has two firms to consider.  Two other firms have indicated their desire to be added to the prequalified list. 

Councilwoman Harrison felt that the last RFQ, done just under a year ago, would be too costly for the firms having submitted proposals to re-submit.  She also asked why the firms missed the RFQ a year ago. 

Councilman Datwyler concurred feeling the process should be extended to 2 – 3 years review.

Councilman Datwyler moved to table the item seconded by Councilman D Burke.

Ox Ditch Recirculating Kenaff Pumps Additional Pumps:

Scott Humphreys and Marvin Fielding came forward and updated the council on the need to purchase two additional recirculating pumps for the second ox ditch and to purchase a third in the existing ditch.  The single pump will not circulate the media sufficiently without it dropping to the bottom of the ditch.  They have contacted Novoda about the issue and Novoda feels adding a second circulating pump will keep the media suspended.  They did reach out to another city which uses the pump but they use a 100 hp pump with a larger fan and have no problems.  Humphreys and Fielding both feel having two 25 hp pumps or smaller will be sufficient.  When asked about the price difference between the 100 horse and 25 horse  they stated they have not gotten prices for a 100 horse pump. 

Councilwoman Harrison moved to authorize the purchase of three circulating pumps at a cost not to exceed $149,000 seconded by Councilwoman King.

Other Council Business:

Police: Councilwoman King asked about parking on Courthouse Way and Pleasant County Way.  She was informed the police have requested public works to erect no parking signs.  After further discussion about the continual violations of parking why parking tickets were not be issued, Officer C Scott indicated the department would begin issuing tickets tomorrow on any violations. 

Christmas Party: The mayor indicated the council needed to fix a date and time when to host the annual Christmas party.  Council decided to move the council meeting from December 2 to December 9 and have the dinner at Lil Mike’s on Dec 2 at 6:00pm.

Councilman Datwyler moved to cancel the city council meeting of December 2 and to reschedule it on December 9 seconded by Councilman D Burke.

Approval of Minutes:

November 4, 2021: Councilwoman Harrison moved to approve the minutes of November 4, 2021 seconded by Councilman Datwyler. 

The mayor called for a voice poll:  all in favor none opposed with Councilman R Burke abstaining. 

November 11, 2021: Councilwoman Harrison moved to approve the minutes of November 11, 2021 seconded by Councilwoman King. 

The mayor called for a voice poll:  all in favor none opposed. 

Approval of Bills:
