Public Comment:

Proclamation:
The mayor read the proclamation declaring June 24, 2023 as Rigby Lions Club Day and urged all citizens to honor the Lions Club for their work serving the community the week of June 18 – June 24, 2023. (Copy attached)
Request for Water Services Inside Impact Area:
Reed Thurgood is requesting the city provide water service to his proposed development. The development contains 5 acres and is north of 400 N. Water services run along 400 North and to the north of on 4000 East and lays within the city’s impact area and is adjacent to city property. Sewer services are not available at that location currently. Mr. Thurgood does not want to annex into the city without services being provided for the development. Councilwoman King felt the property should be annexed to receive water. Councilman Burke felt the question should be presented before the planning and zoning commission. Councilman Wilder was uncomfortable granting an exemption for water service being the property borders the city and it is within the area of impact. Councilman Orme commented one of the points the public expressed to him during his campaign was uncontrolled growth.
Councilwoman King moved to deny the request for water service without the property being annexed into the city seconded by Councilman D Burke.

Water Study:
Jaden Jackson from Keller’s Engineering stepped forward and updated the council on the progress of the water study which was awarded to Keller in October 2021. Mr. Jackson stated they have provided the city with a list of water services they felt needed to be ranked by the city in order of need. After this is completed, Keller will present the report to DEQ and then the city council. The clerk reminded Jackson of the need for public comment and the report should have been completed on or before June 15, 2023. Jackson thought the study would be presented at the next council meeting, July 6, 2023, and the public comment sometime after that.
Wilson Park Change Order:
Mitch Bradley updated the council on a proposed change order concerning the expansion of electrical panels in Wilson Park. The changes entail two panels east of the park along the ballfield, adding a breaker panel in the shelter and extending electrical service to the Bob Brown shelter. The cost of the changes totaled $18,949.30. The electrical contractor is crediting the cost of the project $7,729.62 leaving the balance of $11,219.68. Todd Stowell of Hot Classic Nights Car Show would fund the balance, $11,219.68. The proposed change order would still need approval from Idaho’s Community Block Grant.
Councilman D Burke moved to approve the change order, being no cost to the city, seconded by Councilman Wilder.

Change Order Blaine St Project:
Mitch Bradley stated he had met with the contractor on the issues of the road base on Blaine Street. The contractor has agreed to split the cost of upgrading the road with the city. The proposed split is near 50/50 with the city picking up the cost of upgrading the geo tech to a higher-grade material for around $1,080. The city’s share as proposed is $19,120. This amount is subject to change and is only an estimate.
Council Wilder moved to authorize the mayor to sign a change order on the Blaine St project not to exceed $25,000 seconded by Councilman Orme.

Boring Permit:
Mitch Bradley explained to the council the issues he has had with companies using boring to install fiber optics service lines. The bores are causing issues with the bore going through sewer lines and later the lines are backing up in the homes/businesses. The fee for a bore permit is $10,000 which is being retained for 12 months and upon final approval $9,500 will be refunded to the company. In addition, the city is requesting a $500,000 warranty bond issued for the same 12-month period. The boring permit is in addition to an excavation permit for an open trench dig. Both require a $500,000 warranty bond. A public hearing is scheduled for this on July 6, 2023. The council’s consensus was for acceptance with the permit and reasons for the 12-month period.
Fireworks Permits:
Six vendors have made application for fireworks permits: Tristin Farmer, Bryan Busman, David Weaver, Paul Bradley, Broulims, and David Webster.
Councilwoman King moved to approve the issuance of the fireworks permit to the listed vendors seconded by Councilman Orme.
The mayor called for a voice poll: all in favor none opposed.
Financial Statements:
The clerk reviewed the financials statement for the period ending April 2023. He noted the budget to actual in revenues and expenditures were in line with prior years and within budget. Expenditure to date were below budget but were expected to increase once the summer work begins. Comment on the snow removal was expressed that it had exceeded budget but in the road fund was still under budget with the seal coating expense yet to be expended, in which case the fund may equal its budget.
The journal entries were reviewed for recurring interest earnings which were exceeding last year’s earning with higher interest rates being earned and the recurring internal credits and changes being made.
Police Update:
Chief Fullmer updated the council on project to date:
- Training for himself and other officers has been ongoing both in Boise and in Pocatello.
- The Urban Renewal Agency is paying one-half of the cost of the evidence room costs.
- The closing off the back door with cement block and new passage door is being installed.
- Statistical monthly report presented the council with 280 incidents, 285 traffic stops, 43 infractions citations, and 10 arrests including one for car burglary and theft.
New Dog Boarding Agreement:
The chief presented the council with a new agreement between the city and Mountain River Vet Clinic to impound dogs. The agreement provides for additional fees to be issued to retrieve the dog and for surrendering the dog with a violation of $200. The chief commented that Mountain River boarding fees are lower than other cities are paying.
Councilman Wilder moved to approve the agreement with Mountain River seconded by Councilwoman King.

Other Council Business:
- Summer Picnic – Councilman D Burke will coordinate the employee summer picnic which he suggested being held on July 27 at 6:00pm. The shelter will be reserved on that date.
- Stampede Days – Mayor Datwyler mentioned the city will have the firetruck in the parade and council members are encouraged to participate.
Approval of Minutes:
Councilman Wilder moved to approve the minutes of June 1, 2023, seconded by Councilwoman King.
The mayor called for a voice poll: all in favor none opposed.
Approval of Bills:
The clerk stated one check in the amount of $700 needed to be voided from the approval list. Councilwoman King moved to approve the bills less the $700 check seconded by Councilman Wilder.
